Business meeting “Private Law and Arbitration”

On September 24-25, 2020, the Russian Institute of Modern Arbitration organized an offline event "Private Law and Arbitration" in Kaliningrad in the format of a business meeting. Loys Attorneys at Law became a general partner of the event. The partners of the event – Monastyrsky, Zyuba, Stepanov and Partners and Solntsev and Partners law firms.

On the first day of the meeting, two sessions dedicated to general issues of private law and arbitration were held.

During the first session "Private law in modern realities" Roman Bevzenko (Partner at Pepeliaev Group) outlined five myths related to a unified real property unit. Olesya Petrol (Partner at Petrol Chilikov Law Offices) analyzed the current trends in tort law. Rimma Malinskaya (Counsel at the Bryan Cave Leighton Paisner) examined the issue of liability of a controlling person. Stanislav Solntsev (Managing Partner at Solntsev and Partners Law Firm) shared his view on the need to reform the instrument of legal fees’ recovery. In conclusion, the moderator of the session Andrey Egorov (Editor-in-Chief of the Russian School for Private Law Journal, Director of the Center for Comparative Law of the HSE, head of educational programs at the Lextorium.com School for Practicing Lawyers) discussed the limitation, expansion and clarification of liability in the law of obligations.

The moderator of the second session "State Courts and Arbitration" was Yulia Mullina (Executive Administrator of the Russian Arbitration Center). During the session, Andrey Panov (Counsel at Allen & Overy) analyzed the peculiarities of drafting arbitration clauses and their possible defects. Andrey Egorov (Editor-in-Chief of the Russian School for Private Law Journal, Director of the Center for Comparative Law of the HSE, head of educational programs at the Lextorium.com School for Practicing Lawyers) discussed the impact of bankruptcy procedures on arbitration. Valeria Butyrina (Legal Counsel of the Russian Arbitration Center) told about the attitude of state courts to arbitration in the context of enforcement and annulment of arbitral awards in Russia. The last two speakers of the second session addressed more specific questions: Kirill Udovichenko (Partner at Monastyrsky, Zyuba, Stepanov and Partners Law firm) considered the issue of enforcement of arbitral awards against the state, and Leonid Kropotov (Counsel at DLA Piper) shared his opinion on the perspectives of resolving disputes in foreign arbitration institutions without PAI status in the Russian Federation.

The second day of the business meeting consisted of two sessions that addressed topical trends in arbitration.

During the first session, Roman Zaitsev (Partner at Dentons) discussed the development prospects for interim measures in arbitration, while Evgeny Rashchevsky (Partner in Egorov Puginsky Afanasiev & Partners Law Offices) provided an analysis of cross-border energy supplies and the opportunities for the Russian PAIs in relation to them. In conclusion, Maria Lyubimova (Head of International Disputes and Arbitration Practice at Regionservice Bar Association, consultant at The Private Law Research Centre under the President of the Russian Federation named after S.S. Alekseev) described the present, past and future of sports arbitration in Russia. Andrey Panov (Counsel at Allen & Overy) moderated an active discussion between the speakers and participants of the session.

The second session “Corporate Law. Development prospects of Corporate Disputes Arbitration” was moderated by Mikhail Ivanov (Partner at Dentons). Yulia Mullina (Executive Administrator of the Russian Arbitration Center) considered the possibility of transfer of corporate disputes to arbitral institutions. Tatiana Neveeva (Counsel at Egorov Puginsky Afanasiev & Partners Law Offices) analyzed the arbitrability of corporate disputes, while Egor Chilikov (Partner at Petrol Chilikov Law Offices) focused on indirect claims in arbitration. In conclusion, Dina Iskanderova (Associate at Cleary Gottlieb) told about practical aspects of redomiciliation in Russia.

On September 26, 2020, a Public talk on private law and arbitration was held in the premises of Law Institute of Immanuel Kant Baltic Federal University. Roman Bevzenko (Partner at Pepeliaev Group LLC) and Andrey Panov (Counsel in Allen & Overy) took part in the event as speakers, while Maria Lyubimova (Head of International Disputes and Arbitration Practice at Regionservice Bar Association, consultant at The Private Law Research Centre under the President of the Russian Federation named after S.S. Alekseev) took a role of a moderator. The students of the Law Institute of Immanuel Kant Baltic Federal University had the opportunity to attend the event. Other participants could join a live broadcast of the event at the Russian Arbitration Center Youtube channel.

Roman Bevzenko shared his story of choosing a legal career. Andrey Panov highlighted the advantages of obtaining LLM degree, and pointed at the appropriate time for doing this. The speakers exchanged the secrets of judicial eloquence and shared their experience on the preparation for oral hearings, including online hearings taking into account the specifics of today's reality. In the course of the event, speakers provided the answers to interesting legal questions. Particularly, the speakers analyzed principle of freedom of contract and principle of proportionality as part of a public policy for the purposes of enforcing foreign arbitral awards.

The event was held under the auspices of the Young IMA (Young Institute of Modern Arbitration). Young IMA is a platform that brings together young professionals in the field of arbitration and alternative dispute resolution with the support of the Russian Institute of Modern Arbitration.

Sabina Ganieva (Head of the Young IMA Committee for the Development of Arbitration in the Regions, Legal Counsel of the Russian Arbitration Center) told about the structure of the Young IMA, the opportunities to engage in scientific activities in the field of arbitration for young professionals.
